Terms and Conditions of Use of the MycoSignal Application

Article 1 – Publisher Identification

The mobile application MycoSignal (hereinafter the “Application”) is published by Mr. Bertrand Llorens, sole proprietor operating under the name Bertrand Llorens, registered under SIREN number 832 503 098 and SIRET number 832 503 098 00028, whose registered address is located at 1047 rue Centrayrargues, 34000 Montpellier, France.

Article 2 – Purpose of the Terms and Conditions of Use

These Terms and Conditions of Use (hereinafter the “Terms”) define the conditions under which any user (hereinafter the “User”) may access and use the Application.

The Application is available on compatible iOS and Android devices and is intended, at launch, for the territory of mainland France excluding Corsica.

Any use of the Application implies full, complete, and unreserved acceptance of these Terms.

Article 3 – Purpose and Nature of the Service

MycoSignal is intended exclusively to provide, through a map-based interface, indicators of environmental conditions estimated to be more or less favorable to the development of certain edible mushroom species.

The Application does not constitute:

  • a mushroom identification tool;

  • a service guaranteeing the actual presence of mushrooms;

  • a mushroom foraging advisory service;

  • a guarantee of presence, harvest, edibility, accessibility, legality, or safety.

The Application only provides the User with an algorithmic estimate of environmental conditions, based on parameters and data sources determined by the publisher.

Article 4 – Mushroom Species Covered

As of the date of this version, the species currently taken into account by the Application may include, in particular:

  • pine bolete;

  • summer bolete;

  • bronze bolete;

  • chanterelles;

  • hedgehog mushrooms;

  • morels;

  • black trumpets.

This list is provided for information purposes only, is not exhaustive, and may be changed at any time.

The publisher reserves the right to add, remove, rename, or modify, at its sole discretion, the species taken into account by the Application, without prior individual notice.

Article 5 – Display and Operation

Depending on the zoom level used by the User, the Application may display:

  • visual markers indicating areas with at least mixed conditions;

  • forest polygons derived from pre-recorded mapping data, associated with an estimated condition level.

Condition levels are represented in particular by the following color code:

  • dark green: highly favorable conditions;

  • light green: favorable conditions;

  • orange: mixed conditions;

  • grey: unfavorable conditions.

The User expressly acknowledges that these graphic, visual, and cartographic representations are only summary indicators and may not be interpreted as confirmation of the actual presence of mushrooms in the relevant area.

Article 6 – Calculation Parameters

The scores and condition levels displayed in the Application are determined by means of a proprietary algorithmdeveloped by the publisher.

Depending on the species concerned, this algorithm may notably take into account the following parameters:

  • rainfall over the last 14 days;

  • rainfall over the last 7 days;

  • soil moisture;

  • soil temperature;

  • air temperature;

  • meteorological data analyzed over the last 20 days;

  • soil pH;

  • soil composition in terms of silt, sand, and clay percentages;

  • seasonality, including the month of the year.

The publisher reserves the right to modify, at any time and without prior individual notice, the calculation criteria, their weighting, their method of use, the datasets used, and any algorithmic interpretation rules.

Article 7 – Data Sources

As of the date of this version, the Application may notably rely on the following data sources and datasets:

  • Open-Meteo, for certain meteorological and environmental data;

  • data relating to French soil pH made available through Silvae / AgroParisTech;

  • soil composition data, including the files sable.0_5.tif, argile.0_5.tif, and limon.0_5.tif, made available through Entrepôt Recherche Data Gouv;

  • forest mapping data from the French National Forest Inventory / IGN.

These sources are provided by third parties independent from the publisher. The publisher does not guarantee their completeness, continuous availability, timeliness, or absolute accuracy.

The User acknowledges and accepts that the information displayed by the Application depends in particular on the quality, availability, precision, update frequency, and inherent limitations of these third-party sources.

Article 8 – Access to the Application

The Application is accessible to the general public.

Its use does not require the creation of a user account and may be carried out without registration.

However, access to the Application requires:

  • a compatible device;

  • an Internet connection;

  • where applicable, acceptance of the technical permissions necessary for the functioning of certain features.

The publisher does not guarantee the compatibility of the Application with all devices, operating systems, software versions, hardware configurations, or communication networks.

Article 9 – Geolocation

The Application may request access to the User’s exact location, solely for the purpose of centering the map and improving navigation comfort.

Geolocation is optional. Refusing to grant this permission does not necessarily prevent general use of the Application, but may limit certain display or navigation features.

The User remains solely responsible for the permissions granted to the Application on their device and may modify them at any time in their device settings.

Article 10 – Essential Warning

MycoSignal provides environmental indicators and not a guarantee of presence, harvest, edibility, or safety.

In particular, an area displayed as favorable or highly favorable does not mean:

  • that mushrooms are actually present;

  • that harvesting is possible or abundant;

  • that access to the land is free, authorized, or safe;

  • that mushroom picking is lawful there;

  • that any specimens potentially found are edible;

  • that no natural, material, health, or legal risk exists.

The User is informed that the Application only provides an indicative aid for assessing environmental conditions, and not certain or binding information.

Article 11 – No Mushroom Identification Function

The Application has no mushroom identification purpose whatsoever.

It does not make it possible to determine whether a specimen found in nature is edible, inedible, toxic, or deadly.

The User acknowledges that certain mushroom species commonly regarded as edible may be confused with dangerous, toxic, or deadly species.

Accordingly, the User must not consume any mushroom solely on the basis of the information, maps, scores, colors, or indications provided by the Application.

Any uncertain harvest must be checked by a pharmacist or a qualified mycologist.

Article 12 – No Substitute for Professional Advice or Applicable Rules

The Application does not in any way replace:

  • professional advice;

  • field knowledge;

  • mushroom identification verification;

  • local access or picking rules;

  • respect for private property;

  • respect for protected areas;

  • compliance with laws and regulations applicable to forests, natural areas, or harvesting.

The User remains solely responsible for carrying out all checks required before any trip, entry onto land, or mushroom picking activity.

Article 13 – User Obligations

The User undertakes to use the Application fairly, personally, reasonably, and in accordance with its intended purpose.

In particular, the User undertakes to:

  1. not use the Application as a mushroom identification tool;

  2. not infer from the displayed information that mushrooms are certainly present;

  3. verify independently the accessibility of places, applicable local rules, and the legal status of the land;

  4. respect private property, protected areas, and all applicable safety and legal rules;

  5. refrain from harming the operation, integrity, security, or availability of the Application.

The User remains solely responsible for:

  • their travel and movements;

  • their harvesting decisions;

  • mushroom identification;

  • compliance with local regulations;

  • respect for private property;

  • respect for protected areas;

  • any decision made on the basis of the information displayed by the Application.

Article 14 – Prohibited Uses

Unless prior written consent has been obtained from the publisher, the User is strictly prohibited from:

  • copying all or any substantial part of the content of the Application;

  • extracting, scraping, aggregating, indexing, or reusing in an automated or large-scale manner the data, content, scores, or map representations;

  • carrying out any scraping, automated collection, or systematic extraction;

  • reproducing, redistributing, publishing, commercializing, assigning, renting, or reselling data or content from the Application;

  • reproducing the displayed cartography other than for strictly personal and non-commercial use;

  • circumventing technical protection measures;

  • attempting unauthorized access to the servers, databases, interfaces, or internal mechanisms of the Application;

  • carrying out reverse engineering, decompilation, disassembly, reverse design, or any attempt to reconstruct the algorithm, except within the strict mandatory limits permitted by law.

Article 15 – Intellectual Property

The name MycoSignal, the logo, the scores, the algorithm, the text content, and all original elements making up the Application are protected by intellectual property law and remain the exclusive property of the publisher or its rights holders, as applicable.

Nothing in these Terms shall be interpreted as transferring any intellectual property rights to the User.

The User is only granted a personal, private, non-exclusive, non-transferable, and non-commercial right to use the Application within the strict scope of its normal functionalities.

Screenshots for strictly personal use are permitted, provided they do not give rise to any commercial exploitation, misleading redistribution, mass reuse, data extraction, or infringement of the publisher’s rights.

Article 16 – Advertising and Third-Party Services

As of its launch date, the Application is provided free of charge and funded in particular through the display of advertisements.

The Application may rely on technical services operated by third parties, notably for:

  • cartography;

  • hosting or delivering certain data;

  • crash reporting;

  • advertising delivery.

As of the date of this version, the Application may notably use services provided by Google Maps, Firebase, Firebase Crashlytics, AppLovin Max, and Open-Meteo.

The publisher shall not be held liable for limitations, interruptions, malfunctions, display defects, delays, or unavailability attributable, in whole or in part, to such third-party providers.

The publisher reserves the right to introduce, at a later stage, paid features, an ad-free version, a subscription, or any other additional commercial model. Where applicable, specific contractual terms may supplement these Terms.

Article 17 – Availability of the Application

The publisher endeavors to ensure a reasonable level of availability of the Application.

However, the Application may be suspended, interrupted, slowed down, partially unavailable, or affected by anomalies, notably in the event of:

  • maintenance;

  • updates;

  • bugs;

  • technical incidents;

  • unavailability of a third-party provider;

  • network disruption;

  • force majeure;

  • or any other event beyond the publisher’s reasonable control.

The publisher is bound only by a best-efforts obligation and does not undertake any obligation of permanent availability, error-free service, result, or guaranteed support or intervention time.

Article 18 – Changes to the Application

The publisher reserves the right, at any time and without prior individual notice, to modify, suspend, restrict, withdraw, or develop all or part of the Application, including:

  • its functionalities;

  • its interface;

  • its calculation criteria;

  • the species taken into account;

  • its data sources;

  • its access methods;

  • its business model.

The User acknowledges that the Application may evolve continuously and that the currently available version may differ from any version previously used.

Article 19 – Suspension or Restriction of Access

The publisher reserves the right to suspend, restrict, or block access to all or part of the Application, temporarily or permanently, without compensation, notably in the event of:

  • abuse;

  • fraud;

  • attempts to compromise security;

  • scraping;

  • automated extraction;

  • use contrary to these Terms;

  • conduct likely to harm the interests of the publisher, the Application, or third parties.

The absence of a user account does not prevent the publisher from implementing any technical restriction or protection measure it deems appropriate.

The User may stop using the Application at any time by uninstalling it from their device.

Article 20 – Liability

The information, scores, colors, maps, polygons, estimates, and content provided by the Application are supplied for informational purposes only.

To the extent permitted by law, the publisher shall not be held liable for any direct or indirect damage resulting in particular from:

  • the absence of mushrooms in a place or area;

  • an incorrect interpretation of the Application by the User;

  • intoxication, poisoning, health issues, or any consequences related to the consumption of a mushroom;

  • any accident, incident, fall, injury, or damage occurring during travel in a forest, natural area, or any other location;

  • any penalty or dispute related to unlawful mushroom picking;

  • trespassing on private land;

  • access to a prohibited, regulated, or dangerous area;

  • inaccurate, outdated, unavailable, or insufficiently updated third-party data;

  • technical, software, hardware, or network failure;

  • incompatibility of the User’s device;

  • use of the information displayed by the Application in a manner contrary to these Terms.

In any event, nothing in these Terms shall exclude or limit any liability that cannot be excluded or limited under applicable law.

Article 21 – Personal Data

The processing of personal data carried out in connection with the Application is governed by a separate Privacy Policy, already published by the publisher.

That Privacy Policy specifies, in particular, the categories of data processed, the purposes pursued, the applicable legal bases, any recipients, retention periods, and the rights of the data subjects.

Article 22 – Amendments to the Terms

The publisher reserves the right to amend these Terms at any time.

The version enforceable against the User is the version in force on the date of use of the Application.

By continuing to use the Application after an update to the Terms, the User is deemed to have read and accepted the new version.

Article 23 – Prior Complaint and Consumer Mediation

For any complaint, the User is invited to contact the publisher first at the following address: contact@mycosignal.fr.

Where acting as a consumer, the User may, after first sending a written complaint to the publisher that remains unsuccessful, have recourse free of charge to a consumer mediation scheme.

  • online via the CM2C website;

  • by email;

  • or by post to the address above.

For professional Users, the parties shall endeavor to seek an amicable solution before bringing any legal action.

Article 24 – Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute and failing an amicable resolution, the competent courts shall be determined in accordance with the applicable legal rules.

For Users acting as consumers, the protective jurisdiction rules provided for under consumer law shall remain fully applicable.
